Florida is a no-fault state: your own auto policy’s personal injury protection (PIP) pays for your care after a crash, whoever was at fault, as long as you are seen within 14 days. How PIP billing works

  • PIP pays 80% of reasonable medical expenses, up to $10,000 when an emergency medical condition is documented and $2,500 when it is not; your policy deductible applies first.
  • MedPay, if your policy includes it, can cover the remaining 20% and expenses beyond PIP.
  • Health insurance can be billed as secondary once PIP is exhausted — bring both cards.
  • Records and bills go to your carrier, and to your attorney on request with a signed authorization.

Florida no-fault basics

  • Every Florida-registered vehicle carries at least $10,000 of PIP; it pays your medical bills regardless of fault.
  • Treatment must begin within 14 days of the accident, and follow-up care must be referred by the initial treating physician, PA, nurse practitioner, hospital or urgent care.
  • The full $10,000 is available when an emergency medical condition is determined by a physician, PA or nurse practitioner; otherwise medical benefits are limited to $2,500.
  • Non-emergency care such as massage and acupuncture is not payable under PIP.

Do I have to be seen within 14 days?

Yes. Florida’s PIP law requires initial treatment within 14 days of the accident for benefits to apply.

Will I pay at the visit?

PIP is billed directly. Your policy deductible and the 20% co-insurance, if any, are explained before you are seen; MedPay or health insurance can cover them.

Do I need a police report?

It helps but is not required to be seen; bring your policy or claim number and the date of the crash.

Can I come in if I was a passenger or a pedestrian?

Yes. Passengers are covered by the policy on the vehicle they were in or their own; pedestrians and cyclists by their own auto policy or a household member’s.
